BOAT RENTAL AND USAGE AGREEMENT
for the Pioneer 15 / 25HP
This agreement covers the rental of the boat ‘Pioneer 15 / 25HP’ (hereinafter referred to as ‘the Boat’) for the agreed rental period — until — and price —. (25% VAT is included in the rental price)
Between: Renesidence Norway AS — owner and lessor of the Boat (hereinafter referred to as the ‘Owner’) and The Renter/Boat Operator – of the Boat (as signed below, hereinafter referred to as the ‘Renter/Boat Operator’).
1. Acknowledgment of Risk
The Renter/Boat Operator acknowledges that using the Boat involves risks, including but not limited to bodily injury, drowning, capsizing, collisions, and material damage. The Renter understands that these risks may also arise due to weather conditions or mechanical failures beyond the Owner’s control. The Renter is aware that these risks are inherent and accepts full responsibility for any consequences.
2. Safety Requirements for Use of the Boat
The Renter/Boat Operator agrees to the following safety requirements and rules while using the Boat:
- Life jackets must be worn at all times by all passengers on board.
- The Boat may not be operated under the influence of alcohol or drugs.
- Only individuals aged 16 or older with basic boating knowledge or a valid boating license may operate the Boat, and only if they have signed this agreement.
- If the boat operator is under 18 years of age, written consent from a parent or legal guardian is required (to be completed below).
- The Boat may not be used in unsafe weather conditions (including strong wind, fog, or high waves).
- The Renter must inspect the Boat prior to use and report any visible damage or technical defects to the Owner immediately.
- The maximum number of passengers allowed on the Boat is 6.
- The Renter/Boat Operator confirms having read the attached ‘Renesidence Norway Water Map Rules’ and agrees to adhere to all rules, restrictions, and no-go zones.
- Renter/Boat Operator agrees to operate the Boat as described in the attached ‘Boat Usage Instructions’. Any deviation from these instructions is at the Renter’s risk.
3. Assumption of Risk
The Renter/Boat Operator fully and voluntarily assumes all risks associated with the use of the Boat, including but not limited to personal injury, death, or property damage. The use of the Boat is entirely at the Renter’s own risk.
4. Liability Waiver
To the maximum extent permitted under Norwegian law, the Renter/Boat Operator agrees to release, waive, and discharge the Owner (Renesidence Norway AS), including its employees and agents, from any and all liability for any loss, damage, injury, or claim arising out of or in connection with the use of the Boat. This includes any liability arising from negligence. The Owner shall not be liable for damages resulting from acts of God, severe weather, or technical malfunctions not known or reasonably detectable by the Owner at the time of rental.
5. Damage and Indemnification
The Renter/Boat Operator is fully financially responsible for any damage to the Boat, its equipment, or third-party property caused during the rental period, except where such damage is clearly due to a hidden defect not disclosed by the Owner. The Renter agrees to indemnify and hold harmless the Owner against all claims, damages, and expenses (including legal fees) resulting from the Renter’s actions or omissions during the rental.
6. Condition of the Boat
The Boat is provided in good working condition. The Renter/Boat Operator agrees to return the Boat in the same condition. Any incidents or damage must be reported immediately. Failure to report damage may result in full liability for repairs or replacement.
7. Boat trip
The Renter/Boat Operator is always responsible for solving problems during a boat trip and the possible costs that are involved.
8. Governing Law
This agreement shall be governed by the laws of Norway. Any disputes will be subject to the exclusive jurisdiction of the Norwegian courts.
Signed by the Renter(s)/Boat Operator(s) to confirm acceptance of this agreement and the acceptance of the documents referred to: ‘Renesidence Norway Water Map Rules’ and ‘Boat Usage Instructions’. If the Renter/Operator is under 18 years of age, a parent or guardian must sign for consent.
